Terms of Service

Effective Date: January 15, 2026

Welcome to Theqah ("Theqah", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms").

If you do not agree, do not use the Service.

1. About Theqah

Theqah is a software-as-a-service (SaaS) platform that provides WordPress management tools, including updates, monitoring, backups, reporting, and related services.

Theqah operates from Canada.

2. Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to use the Service.

3. Accounts & Access

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity under your account.
  • You agree to provide accurate and current information.

4. Service Scope & Limitations

Theqah provides automation and monitoring tools only.

You acknowledge that:

  • WordPress websites, hosting environments, themes, plugins, and servers are third-party systems not controlled by Theqah.
  • Updates, backups, scans, or monitoring may fail due to factors outside our control.
  • Theqah does not guarantee uninterrupted service, error-free operation, or prevention of data loss.

5. No Warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Security or reliability of third-party systems

6. Limitation of Liability

To the maximum extent permitted by Canadian law:

  • Theqah shall not be liable for indirect, incidental, consequential, special, or punitive damages.
  • Theqah's total liability shall not exceed the amount paid by you to Theqah in the three (3) months preceding the claim.

This includes, without limitation:

  • Data loss
  • Website downtime
  • Plugin or theme conflicts
  • Security incidents originating outside Theqah's systems

7. User Responsibilities

You agree not to:

  • Use the Service for unlawful purposes
  • Attempt to reverse engineer or abuse the platform
  • Upload malicious code
  • Manage websites without proper authorization

8. Healthy WordPress Environment Requirement

Theqah's services and features are designed to operate with a properly installed, configured, and maintained WordPress environment (a "Healthy WordPress Installation"). You are responsible for ensuring that your WordPress site, hosting environment, and all related components—including the WordPress core, themes, plugins, database, file permissions, server configuration, and required PHP/MySQL versions—are stable and free from material errors, malware, corruption, misconfiguration, or other conditions that may impair functionality.

Theqah does not guarantee performance, compatibility, or successful operation of any service in environments that are unhealthy, unsupported, compromised, or otherwise not in a normal working state, and Theqah may suspend, limit, or decline to perform services where such conditions exist.

Where feasible, Theqah may provide reasonable guidance or recommendations to remediate issues; however, remediation work may be outside the scope of the services and may require additional effort or fees as permitted under these Terms.

9. Payments & Billing

  • Subscription fees are billed in advance.
  • Trial availability and site limits vary by plan.
  • Fees are non-refundable except where required by law.

10. Suspension & Termination

We may suspend or terminate access if you:

  • Violate these Terms
  • Abuse the Service
  • Pose a security or legal risk

You may cancel your account at any time.

11. Third-Party Services

Theqah integrates with third-party services (e.g., hosting providers, payment processors).

We are not responsible for third-party service availability or failures.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

15. Managed Hosting Addendum

This addendum applies when you subscribe to Theqah Managed WordPress Hosting plans. By using our hosting services, you agree to these additional terms.

15.1 Service Description

Theqah Managed WordPress Hosting provides:

  • Optimized WordPress hosting infrastructure
  • Automatic SSL certificate provisioning via Let's Encrypt
  • PHP 8.2 with optimized FPM pools per site
  • MariaDB database per site with isolated credentials
  • Daily automated backups
  • Resource isolation between hosted sites

15.2 Acceptable Use Policy

You agree NOT to use Theqah Managed Hosting for:

  • Hosting illegal content or activities
  • Running cryptocurrency mining, torrent trackers, or proxy services
  • Hosting phishing sites or malware distribution
  • Sending spam or unsolicited bulk email
  • Hosting adult content, gambling, or pirated material
  • Any activity that violates applicable laws
  • Running non-WordPress applications or using hosting as a general-purpose server

Violation of this Acceptable Use Policy may result in immediate suspension or termination without refund.

15.3 Fair Usage Policy

Theqah Managed Hosting is designed for typical WordPress sites. The following resource limits are actively enforced:

Resource Limits Per Site

  • Storage: 10 GB per site (Freelancer), 20 GB per site (Agency)
  • Bandwidth: 100 GB/month per site
  • PHP Memory: 256 MB per request (configurable up to 512 MB)
  • PHP Execution Time: 300 seconds default (configurable)
  • Database Size: 2 GB per site
  • Email: Not included (use external SMTP provider)

Enforcement

These limits are system-enforced. When a limit is reached:

  • Storage: New uploads may be rejected until space is freed
  • Bandwidth: Site may be temporarily throttled or suspended until the billing cycle resets
  • PHP Memory/Time: Requests exceeding limits will fail (HTTP 500 error)
  • Database: Writes may be rejected when the size limit is reached

We will attempt to notify you before enforcement actions take effect, but automated systems may act immediately to protect shared infrastructure. Contact support to discuss upgrades if you consistently approach these limits.

15.4 Technical Limitations

The following technical limitations apply to all hosted sites:

  • No SSH or root access (managed environment)
  • No custom server configurations outside WordPress
  • No installation of non-WordPress applications
  • PHP version is standardized (currently 8.2)
  • Outbound connections may be rate-limited
  • Cron jobs limited to WordPress scheduled tasks

15.5 Responsibility Boundaries

Theqah Manages:

  • Server infrastructure & security
  • Operating system updates
  • PHP & database server maintenance
  • SSL certificate renewal
  • Server-level backups
  • Network security & DDoS protection

You Manage:

  • WordPress core, themes & plugins
  • Site content & media
  • User accounts & permissions
  • Plugin compatibility & conflicts
  • Site optimization & caching
  • GDPR/legal compliance for your content

15.6 Data & Backups

  • Daily automated backups are retained per your plan (14 days Freelancer, 30 days Agency)
  • You can request a restore through your dashboard
  • You are responsible for maintaining independent backups of critical data
  • Data deletion requests will be processed within 30 days

15.7 Availability

Our goal is to maintain high availability for our hosting infrastructure. The following are excluded from any availability calculations:

  • Scheduled maintenance windows (announced 24 hours in advance where possible)
  • Upstream provider outages (datacenter, network, DNS providers)
  • Issues caused by your WordPress installation, plugins, or themes
  • DDoS attacks or other malicious activity targeting your site or our infrastructure
  • DNS misconfiguration or propagation delays on your domain
  • Force majeure events (natural disasters, war, government actions)

No Service Level Agreement (SLA) or service credits are provided unless explicitly stated in a separate written agreement or order form. For mission-critical deployments requiring contractual uptime guarantees, please contact us about Corporate plans.

15.8 Suspension & Termination

We may suspend or terminate your hosted sites:

  • Immediately for AUP violations
  • After 7 days for payment failures
  • For excessive resource usage affecting other customers
  • Upon your request via support ticket

After subscription cancellation, your data will be retained for 30 days before permanent deletion.

15.9 Site Migration

If you wish to migrate away from Theqah Managed Hosting, you can download a full backup of your site through the dashboard. We can provide migration assistance for Agency plan customers upon request.

15.10 Hosting Pricing

  • Hosting plans are billed monthly or annually in advance
  • All prices are listed in USD
  • Billing is processed via Stripe
  • Fees are non-refundable except where required by law

15.11 Changes to Hosting Terms

We may update these Hosting Terms from time to time. Material changes will be communicated via email 30 days before taking effect. Continued use of hosting services after changes take effect constitutes acceptance.
